Eighteen members of a violent gambling ring located principally in California and Peru have been charged in an indictment unsealed today with operating “Macho Sports”—an illegal Internet and telephone gambling business.

Participants in the scheme were accused of taking millions of dollars in illegal sports wagers over the last decade in the San Diego and Los Angeles areas. Earlier today, FBI agents arrested 14 of the defendants in coordinated actions in San Diego and Los Angeles while foreign counterparts arrested defendant Erik Portocarrero in Oslo, Norway. FBI agents also executed seizure warrants seeking the forfeiture of at least $5 million in property associated with Macho Sports, including a La Jolla property obtained by conspirators with proceeds from the illegal gambling conspiracy. The FBI investigation, which started in 2011, employed wiretaps and undercover agents to infiltrate the organization and uncover the defendants’ illegal gambling activities and extortionate debt collection.

According to the indictment, Jan Harald Portocarrero and Erik Portocarrero ran Macho Sports from Lima, Peru, using the Internet and toll-free telephone lines to accept bets from customers in California. The organization ensured the prompt payment of gambling debts through the use of intimidation, threats, and violence, as well as fostering a violent reputation as to its treatment of delinquent customers. The co-conspirators avoided detection by laundering their illegal proceeds and maintaining a company headquarters and the physical platform for its Internet operations outside the United States. Although originally from California, the Portocarrero brothers set up Macho Sports first in Panama and later in Peru after suffering previous gambling arrests or convictions in the United States.

In addition to its telephone and Internet operations. Macho Sports used teams of bookies—such as Amir Mokayef (operating primarily in the San Diego area) and Joseph Barrios (operating primarily in the Los Angeles area)—who were responsible for recruiting customers, paying off winning bets, and collecting on losing bets.

Macho Sports’ bookies often managed their own network of “sub-bookies,” who both recruited customers and delivered payments to the managing bookie. For example, San Diego-area bookie Mokayef managed the sub-bookies Michael Christopher Iaco, Howard Alan Blum, Michael John Massey, Salvatore Giacomo Groppo, Nilesh Kumar Ambubhai Patel, and Benjamin John William Weber. Los Angeles-area bookie Barrios managed the sub-bookies Charles Edward Sullivan, Emed G. Sidaros (aka Action Ed), Isaac Pete Gharibeh, and Todd Michael Heflin.

Macho Sports supplied their customers with an account number and password for accessing their gambling accounts on its websites. Bookies instructed their customers that they could place bets with their bookmaker or by calling Macho Sports’ toll-free numbers or through their online accounts on the Macho Sports websites. Typically, Macho Sports would extend credit to new customers, so they could begin sports betting without pre-funding their accounts. Macho Sports also provided further extensions of credit to existing customers, so that those customers could wager larger amounts of money than their prior extensions of credit allowed.

The enterprise also used “runners,” such as Randall Lee Irwin and Larry Neil Gold, who dealt directly with customers on behalf of its various bookies. These runners handled customer payments and collections. To ensure prompt payment, Macho Sports fostered a violent reputation about its treatment of delinquent customers. To this end, and because Macho Sports could not rely on the legal system for debt collection, the enterprise used intimidation, threats, and violence against its customers, especially when customers were late in paying their gambling debts.

United States Attorney Duffy observed that billions of dollars are being made outside the law now that technology has made illegal gambling more accessible: “Illegal gambling is a thriving illegal business hiding in plain sight. The department is committed to combating this crime, which too often is characterized by organized criminals, shady bookies, serious violence, and lives in shambles because of gambling addiction.” FBI Special Agent in Charge, Daphne Hearn, commented, “This case highlights the connection between illegal Internet gambling operations and the violence associated with this type of racketeering activity. Criminal enterprises like ‘Macho Sports’ and their U.S.-based ‘bookmakers’ prey on the gambling addictions of their betting customers, wreaking havoc on people’s lives and the lives of family members.”

Some defendants are expected to be arraigned on the indictment this afternoon before U.S. Magistrate Judge William McCurine, Jr.

An indictment itself is not evidence that the defendants committed the crimes charged. The defendants are presumed innocent until the United States meets its burden in court of proving guilt beyond a reasonable doubt.

WASHINGTON—Frederick Singletary, 42, of Parkville, Maryland, pled guilty today to federal charges of traveling interstate to engage in illicit sexual conduct with a minor and possession of child pornography, announced U.S. Attorney Ronald C. Machen, Jr.; Valerie Parlave, Assistant Director in Charge of the FBI’s Washington Field Office;; and Cathy L. Lanier, Chief of the Metropolitan Police Department (MPD).

Singletary entered the guilty plea in the U.S. District Court for the District of Columbia. The Honorable Beryl A. Howell is to sentence him on September 20, 2013. Singletary faces a statutory maximum sentence of 30 years of imprisonment for traveling interstate to engage in illicit sexual conduct and a maximum of 10 years of imprisonment for possession of child pornography, as well as a fine of $250,000 on each count.

According to the government’s evidence, on February 12, 2013, Singletary contacted an undercover officer with the FBI’s Child Exploitation Task Force, who had posted an ad on a social networking site. Over the next few days, Singletary engaged in online e-mail, instant message, text message, and telephone conversations with the undercover officer, whom he believed was the father of an underaged girl. During this period of time, Singletary arranged with the undercover officer to meet for the purpose of engaging in sexual acts with the child.

During the course of their communications, Singletary also sent the undercover officer 10 images of child pornography. On February 14, 2013, Singletary traveled from Maryland to a pre-arranged meeting place in Washington, D.C. When he arrived, he was arrested.

This case was brought as part of the Department of Justice’s Project Safe Childhood initiative and investigated by the FBI’s Child Exploitation Task Force, which includes members of the FBI’s Washington Field Office and MPD. In February 2006, the Attorney General created Project Safe Childhood, a nationwide initiative designed to protect children from online exploitation and abuse. Led by the U.S. Attorney’s Offices, Project Safe Childhood marshals federal, state, and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as identify and rescue victims. In announcing the guilty plea, U.S. Attorney Machen, Assistant Director Parlave and Chief Lanier praised the work of the MPD detectives and special agents of the FBI Child Exploitation Task Force. They also commended the efforts of Assistant U.S. Attorney Ari Redbord, who is prosecuting the case.

Hells Angels Members and Associates Convicted and Sentenced After Joint Investigation Uncovers Racketeering Conspiracy Dealing in Guns, Drugs, Armed Robbery, Arson, and Money Laundering

COLUMBIA, SC—As part of a cooperative federal, state, and local investigation, 16 members and associates of the Hells Angels were convicted in federal court of crimes related to a racketeering conspiracy (Racketeer Influenced and Corrupt Organizations Act, also known as RICO Act, 18 U.S.C. §1962). Today, three full-patch members of the Hells Angels—Hells Angels Charter President Mark “Lightning” Baker, as well as “Gravel” Dave Oiler and Bruce “Bruce-Bruce” Long—were sentenced after having been convicted by a jury of racketeering conspiracy, drug trafficking, money laundering, and firearm offenses. United States District Judge Cameron Currie sentenced Baker to 188 months, Oiler to 200 months, and Long to 168 months. Previously, 12 other members and associates of the Hells Angels were sentenced after having pleaded guilty. One defendant, Carlos Hernandez, remains to be sentenced. United States Attorney Bill Nettles said, “We are pleased to partner with federal, state, and local law enforcement in response to community concerns about outlaw motorcycle gangs. Removing machine-guns, silencers, assault rifles, other illegal firearms, and drugs from our streets while disrupting the trafficking activities of violent gangs, such as the Hells Angels, is and will remain a priority of the United States Attorney’s Office.”

Members and associates of the Hells Angels South Carolina Nomads Charter operated from Lexington to Rock Hill, South Carolina. As part of the coordinated criminal activity, the group engaged in drug dealing, money laundering, firearms trafficking, use of firearms in relation to crimes of violence and drug dealing, attempted armed robbery, arson, and other offenses. The Hells Angels’ leadership coordinated the criminal activity and received kickbacks or cuts of the illicit proceeds generated by members and associates of the Hells Angels. During the investigation, the gang’s leadership transitioned from long-time Hells Angels member “Diamond” Dan Bifield to recent inductee Mark “Lightning” Baker after the charter’s members voted Bifield out as president. Throughout, as Baker and Bifield explained in recorded conversations, members of the Hells Angels were to pay a cut of their profits from illegal activity to the Hells Angels and its leadership.

Though professing to live outside the structure of society’s laws as so-called “outlaws” or “one-percenters” (denoting that they are the one percent that refuses to abide by the law), the investigation showed the Hells Angels to have a highly organized hierarchical chain of command governed by extensive written rules. Membership, which is limited to white males that own an American-made motorcycle, requires more than a year of association with the gang. Only full members may wear the three-piece patch with the winged death head that has become synonymous with the Hells Angels.

The investigation revealed that the Hells Angels trafficked in a wide-array of firearms, knowing that the weapons were being sold to known felons for use in armed robberies of other drug dealers. In excess of one hundred guns were trafficked by the group (including by Bifield, Long, Pryor, Keach, and others) and recovered during the execution of search warrants, including fully automatic machine-guns, silencers, assault rifles with high-capacity magazines, pistols, and sawed-off shotguns.

Members of the organization not only supplied weapons, they also supplied methamphetamine (known as “biker’s coffee”) and cocaine, along with bath salts and prescription pain pills. The evidence showed that the defendants were responsible for more than five pounds of methamphetamine and multiple kilograms of cocaine. For example, Baker and Oiler obtained for re-distribution pounds of high-quality methamphetamine from Kerry Chitwood, a member of the Gastonia, North Carolina-based Southern Gentlemen Motorcycle Club. During their drug trafficking activities, club members traded on the Hells Angels’ infamous reputation to instill fear and obtain the drugs they wanted. Similarly, Bifield and Long distributed more than a kilogram of cocaine and bath salts obtained from a variety of sources. Other members of this drug conspiracy (including “Big” Frank Enriquez and Baker) trafficked in prescription pain pills.

“The Hells Angels are one of the most notorious biker gangs in the United States,” FBI Special Agent in Charge David A. Thomas explained. “Working with our federal, state, and local partners, we are committed to using our resources on the most significant problems facing our state. These convictions send a strong message that the coordinated efforts of law enforcement can disrupt, and hopefully dismantle, organized gang activity.”

After a month-long trial, a federal jury convicted Baker of racketeering conspiracy, narcotics conspiracy, and money laundering; Oiler of racketeering conspiracy, narcotics conspiracy, various counts of narcotics distribution and attempted distribution, money laundering, possession of a firearm in furtherance of drug trafficking and a crime of violence, and illegal possession of a machine-gun and silencer; and Long of racketeering conspiracy, narcotics conspiracy, various counts of narcotics distribution and attempted distribution, money laundering, and sale of firearms for use in drug trafficking and a crime of violence. These three received sentences ranging from 14 years to over 16 years.

Previously, six defendants pleaded guilty to a racketeering conspiracy and were sentenced by the court: “Diamond” Dan Bifield (210 months), David “Yard Owl” Pryor (84 months), Richard “Little Mark” Thrower (27 months), “Big” Frank Enriquez (24 months), Fred Keach (10 months), and Johanna Looper (15 months). Three defendants pleaded guilty to a narcotics conspiracy and were sentenced by the court: Kerry “Gowilla” Chitwood (240 months), “Big” Ron Byrum (51 months), and Trent Brown (24 months). Lisa Bifield pleaded guilty to possession of a firearm in furtherance of drug trafficking and a crime of violence and was sentenced to 84 months in prison. James “Sonny” Rhodus pleaded guilty to money laundering, receiving five years of probation, while Bruce “Diesel” Wilson pleaded guilty to selling a firearm to a known felon and received 18 months in federal prison.

“ATF will continue to work in conjunction with other law enforcement agencies to identify organized violent criminals in our joint effort to protect the public,” said ATF Charlotte Division Special Agent in Charge Wayne Dixie, “The sentencing of members and associates of the Hells Angels Motorcycle Club in federal court should send a loud and clear message to anyone who chooses to engage in this type of criminal activity; it cannot and will not be tolerated and you will be held accountable.”

This multi-agency investigation led by FBI Special Agent Devon Mahoney began in response to community concerns about the infiltration of the Rock Hill community by outlaw motorcycle gangs and the brewing violence developing between members of rival outlaw motorcycle gangs. Ultimately, the investigation—through cooperating individuals, surveillance, search warrants, court‑authorized wiretaps, consensual recordings, controlled buys, stings, and other investigative techniques—provided a window into the Hells Angels’ criminal activities that led to these arrests and convictions. This investigative partnership—the South Carolina Hells Angels Task Force—included officers and agents of the Federal Bureau of Investigation; Bureau of Alcohol, Tobacco, Firearms, and Explosives; Lexington Police Department; Lexington County Sheriff’s Department; York County Sheriff’s Department; Rock Hill Police Department; and the South Carolina State Law Enforcement Division (SLED). Twenty-Four Laredoans Indicted on Drug and Money Laundering Charges

LAREDO, TX—Two indictments alleging conspiracy to possess with intent to distribute heroin, cocaine, and methamphetamine, as well as money laundering charges, have been partially unsealed following the arrest of 25 individuals, United States Attorney Kenneth Magidson announced today along with Special Agent in Charge Javier Peña of the Drug Enforcement Administration and Special Agent in Charge Armando Fernandez of the FBI’s San Antonio Division.

During law enforcement actions this morning, agents arrested a total of 24 Laredo residents. Those include

Jaime Tomas Hernandez-Rocha, 45, Pablo Contreras Jr., 41, and Mario Alberto Rodriguez, 26, all of Laredo, are also charged but were already in custody. Also charged and arrested today was Richard Cruz Rodriguez Jr., 46, of San Antonio.

The indictment alleges some of those charged are members and associates of the Texas Mexican Mafia prison gang. The indictments, returned under seal on June 11, 2013, and partially unsealed following the arrests today, remain sealed as to those charged but not in custody.

“Today, DEA and our law enforcement counterparts issued a substantial blow to the Texas Mexican Mafia Laredo Chapter, allegedly one of the strongest Mexican-based cocaine trafficking organizations operating in Texas,” said Peña. “The DEA will continue to assault these types of alleged drug trafficking organizations if they are suspected of brazenly distributing illegal controlled substances throughout our communities.”

“These arrests today should send a clear message to the Texas Mexican Mafia, and other suspected criminal organizations, that law enforcement will not tolerate their alleged violent acts and trafficking of dangerous drugs in our community,” added Fernandez.

The joint investigation began in 2009 and identified some of the defendants as members of the Mexican Mafia distributing cocaine, heroin, and methamphetamine, according to the indictment. Additional defendants were also allegedly associated with the Mexican Mafia and participated in the conspiracy, doing so under the group’s protection. The indictment indicates the distribution of heroin and methamphetamine was organized mainly by Juan Pablo Contreras and Carlos Contreras to other alleged members and associates of the Mexican Mafia and included distribution to locations such as San Antonio, Austin, and Corpus Christi. The investigation also uncovered evidence of the gang’s money laundering activities, part of which revealed efforts to smuggle drug proceeds back to the sources of the drugs in Mexico, according to the indictment.

The charges are the result of an Organized Crime Drug Enforcement Task Force (OCDETF) investigation named Operation X3, which was conducted by agents of the FBI, Drug Enforcement Administration, Homeland Security Investigations, and Internal Revenue Service-Criminal Investigation. They were assisted at different times by the United States Marshals Service, police departments in Laredo, Austin and San Marcos, Customs and Border Protection, Texas Department of Public Safety-Criminal Investigations Division, and the LaSalle and Karnes County Sheriff’s Offices.

Assistant United States Attorneys James Hepburn and Andy Guardiola are prosecuting the cases.

An indictment is a formal accusation of criminal conduct, not evidence. A defendant is presumed innocent unless convicted through due process of law.
